2.1. Prices displayed on Boost Performance website are subject to change without notice. Prices for items on an order are fixed once your order has been accepted. Subsequent price changes either up or down will not be retroactively applied to accepted orders. Prices may be adjusted for any reason, and may vary at any time. All prices are quoted in New Zealand Dollars and do not include GST on the website and in any other correspondence.
3.1 Boost Performance asserts the right to the copyright of all aspects of the website, includes, the trademarks, slogans, logos or designs of the products displayed.
4.0 Faulty or Damaged Goods
4.1 Boost Performance undertakes replace damaged or faulty goods. Goods which are received by customers in a damaged or faulty state, will be either repaired or replaced at the discretion of Boost Performance. If replacement of such goods is not possible, a refund will be issued for the full value of the damaged goods.
5.0 Order Cancellation
5.1 Though Boost Performance will endeavour to supply orders placed and accepted on this website, order placement and acceptance do not constitute an absolute obligation on Case Media to supply. Boost Performance reserves the right to cancel any order without notice. Boost Performance obligations will be limited to protections provided by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
5.2. In the event of any cancelled order, cheque or direct debit payments will be refunded in accordance with the Consumer Guarantees Act 1993. In the event that credit card payment is processed for a cancelled order, refunds will be processed in accordance with the Consumer Guarantees Act 1993.
5.3 Customers who wish to cancel any order must notify Boost Performance by email by 10am on the next business day following the date of order.
6.1 Boost Performance will only accept returns for the following:
• Goods damaged prior to delivery
• Goods with manufacturing faults
• Goods supplied incorrectly
• Goods that vary from their description on the Boost Performance website
7.1 Any submission between Boost Performance and any customer is to be treated as a submission to Boost Performance. By making any submission to Boost Performance you are granting Boost Performance absolute use of the materials, ideas, suggestions, concepts or comments and transferring ownership of ideas to Boost Performance. Boost Performance is not required to name the customer, compensate the customer or reward the customer in any way, unless required by law.
8.1 Boost Performance is not liable in any way for any alleged damages arising from the use of this site. This applies to alleged damages of any kind, including direct, indirect and incidental, loss of income, profit, data, property and claims by third parties.

9.1 Boost Performance displays products in a variety of ways – however colours displayed on a screen vary and may not represent the exact same colours in reality. Boost Performance is not responsible or liable for any possible loss incurred through the colours of the website not matching reality.
10.0 Delivery Policy
10.1 Delivery charges are calculated and added to your order after you enter your delivery location and before you enter your credit card details. You get to see the full charge before completing your purchase. We deliver anywhere within New Zealand and estimated delivery times are stated with the shipping option chosen by or for you. Some isolated areas may require additional delivery time, and delivery times are determined from the moment payment is received.
11.0 Payment Terms
11.1 Any Account deemed to be in default, shall be forwarded without delay to our Debt Collection Company. The debtor will incur all charges pertaining to the collection of this debt.
